as it still is.  However, the developer now argues that the City is creating a hardship by standing by its policy that the land be developed as all residential.  In fact, very high-density residential development is permitted on much of the tract and there are several high-density residential projects in the area.

The City's attorney, David Blum did a fine job in defending the City and our neighborhood.  Since the issues in question in this trial are critical to the residential stability of North Buckhead, NBCA hired Bob Zoeckler of Starnes, Maddox & Nix who joined the City's team as amicus, providing significant legal research.  After NBCA asked for contributions to fund this legal effort, 57 North Buckhead residents and friends generously contributed.  We thank each of you who contributed and especially thank Bob Zoeckler for his contributions to our neighborhood and for his outstanding representation of our interests. 

The trial phase is now over and we are awaiting the judge's decision, expected in a month or two.
