Zoning Report

Recent Zoning actions in North Buckhead include:

Second Condo Tower at Phipps - An application for a site plan amendment to permit a second 500+-foot condo tower at Phipps Plaza was defeated by the City Council.

Rickenbacker Drive - (Z-99-10/CDP-99-7)  Approved by the City Council for 27 townhouses by Core Development.  Seven of the eleven acres nearest the creek will be permanently protected as green space, which, together with the relatively low density of this development, protects this edge of North Buckhead.  The Board of Zoning Adjustment granted a variance for a reduction in the 40-foot required front yard setback to 15 feet. 

Old Ivy Road - (Z-99-23)  Approved by the City Council for 19 townhouses on 2.5 acres directly across from Piedmont Center by Liberty Development.  A landscaping plan, reduction in density and other conditions were worked out with the Old Ivy Condominium Association.  A variance for a reduction in the required 40-foot front yard setback to 30 feet was withdrawn. 

Piedmont Road at Lenox Road - A Text Amendment (Z-99-46) that would have amended the Office/Institutional district regulations to allow a freestanding restaurant as an "accessory use" was denied by the City Council.  This amendment was intended to permit construction by Bone's Restaurant in an area which is now prohibited by the code.

Buckhead Community Improvement District (CID) - The CID is a newly created governmental entity established to improve the business environment (traffic, transportation services, and pedestrian convenience) in Buckhead.  It has the power to tax businesses within its recently established boundaries.  These boundaries include parts of residential North Buckhead (basically that part south of Old Ivy Road or west of Sarah Smith School).  NBCA is acting to determine the legal implications of this inclusion.
