strong majority of the City Council, but both were vetoed by Mayor Bill Campbell.  In neither case were the vetoes overridden by the Council.

Some time ago, we were told that the Georgia Department of Transportation insisted to the developer that there be no curb cut on Roswell Road near the Chick-fil-A (where we think it would be ideal.)  Subsequently, we reviewed the GDOT's files on this development and it is clear that the GDOT initially proposed that there be a curb cut on Roswell Road next to the drive-in.

There have been some efforts to negotiate a solution to this impasse but the sticking point remains the Midvale curb cut.

Should the City prevail in the courts, it will not be a total victory for the neighborhood -- the curb cut won't go away but the Chick-fil-A will;  we would rather have the Chick-fil-A and no Midvale curb cut.  We are pursuing our options and understand that the next door neighbor may be filing suit against the developer.  Any breaking news will be announced at www.nbca.org,  NBCA's website.
