Chick-fil-A & Midvale
2/6 City Council
enacted the so-called "Chick-fil-A" ordinance (section
16-30.004(2) of the Zoning Code) requiring that building permits
be made public knowledge. The ordinance became effective
on 1/25/01. It requires that:
1. All new building permits will be posted on the City's
web site.
2. The Clerk of Council will maintain a public file of new building permits.
3. The recipient of a building permit must post a sign on the property not less than 6 square feet in size, saying
"Notice of Issuance of Building Permit" in letters at least 4 inches high. This sign must be posted within 24 hours and should not be removed for 30 days. The applicant is also required to certify to the Clerk of Council the date the sign was posted.
4. It permits the BZA extend the 30 days appeal period if the recipient had not fully complied with the notification procedures.
