12/6/98 Tree Commission to Hear Appeal of Tree Plan Approval

North Buckhead resident, Kevin McCauley, filed an appeal of the
decision by the City to accept the developer's tree replacement plan
for the Peachtree Gardens subdivision.  There will be a public hearing
by the City's Tree Commission dealing with this appeal ( most likely in
the City Council chambers on Trinity Street) on January 6, 1999 at
6:00 PM.  City officials say the City will not issue building permits
until that appeal is heard.

Subject: North Buckhead News: Peachtree Gardens Subdivision Update

Hi North Buckhead Neighbor,

The following note is from Kevin McCauley, Chair of the North Buckhead
Civic Association's Environmental Committee. His note regards the
pending application to develop the "Peachtree Gardens" property. The
approval Kevin discusses affects 13 of the 15 lots -- the other two
occupied by the clubhouse building are still held up by the Army
Corps of Engineers. The Tree Replacement Plan for the Peachtree
Gardens Subdivision had been seen as the last impediment for the bulk
of this development's go-ahead.

Gordon,

Just wanted to update you on recent events surrounding Peachtree Gardens.
Feel free to pass this on to the rest of the Board and anyone else who
would be interested. Thanks.

The City approved the Tree Replacement Plan for the Peachtree Gardens
Subdivision on Wednesday (11/18). The developer is required to post
notification of approval on the property for 15 days prior proceeding with
development. During this time no trees are permitted to be cut or
disturbed. Within 10 days of the approval date, interested parties may
file an appeal to the Tree Conservation Commission to review the decision
to approve the proposed Tree Replacement Plan. I am looking into the
possibility of filing an appeal. If an appeal is filed, it will probably
be heard 1/20.
